Terms of Use

The following terms and conditions govern all use of the Bulbul app and services (Applications). The Applications are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Bulbul Privacy Policy).

Please read this Agreement carefully before accessing or using the Applications. By accessing or using the Applications, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access or use the Applications. Acceptance is expressly limited to these terms.

1. Use of Our Service

You may use the Service only if you can form a binding contract with Bulbul , and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Anyone under 16 is strictly prohibited from creating an account.

The Service is not available to any Users previously removed from the Service by Bulbul .

2. Your Bulbul Account

If you create a Bulbul account, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify Bulbul of any unauthorized uses of your account or any other breaches of security. Bulbul will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

3. Responsibility of Contributors

If you create or submit any content whatsoever (Content) to the Applications, or allow any third party to create or submit Content to the Applications, you are entirely responsible for the content of, and any harm resulting from, that content. That is the case regardless of whether the Content in question constitutes text, graphics, video, location data, or binary data. By submitting Content, you represent and warrant that:

The downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party.
If any third party has rights to intellectual property you create, you have either (i) received permission from the rights holder to post or make available the Content, including but not limited to any software, or (ii) secured a waiver from the rights holder regarding all rights in or to the Content
You have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms.
The Content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party.
Your account is not named in a manner that misleads people into thinking that you are someone else. Like impersonating another person by using their name, photo, phone number, or email address.
You will comply with all applicable laws and regulations in relation to the Content you submit, including those in your country of residence.
Violation of these terms may result in the removal of your Content, suspension, or termination of your account, and/or legal action.

4. Submitting Content

By submitting Content to Bulbul for inclusion in the Applications, you grant Bulbul a worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish the Content solely for the purpose of operating, improving, and displaying it to other users. If you delete Content, Bulbul will use reasonable efforts to remove it from the database, but you acknowledge that caching or references to the Content may not be immediately unavailable and may persist for a reasonable period.

You are solely responsible for the content you submit and any consequences arising from such content. There is no tolerance for objectionable content or abusive users. Without limiting any of those representations or warranties, Bulbul has the right (though not the obligation) to, at Bulbul’s sole discretion (i) refuse or remove any content that, in Bulbul ’s reasonable opinion, violates any Bulbul policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Applications to any individual or entity for any reason, at Bulbul ’s sole discretion. Bulbul will have no obligation to provide a refund of any amounts previously paid.

5. Responsibility of Application Users

Bulbul does not submit Content to the Applications and therefore cannot be responsible for the Content's nature, use, or effects. By operating the Applications, Bulbul does not represent or imply that it endorses any material posted or that it believes such material to be accurate, useful, or non-harmful. Submitted Content must comply with the community guidelines. Users are solely responsible for their interactions with the Applications and must ensure their use complies with all applicable laws and the community guidelines. Users should independently verify the accuracy and legitimacy of any content before relying on it. Bulbul disclaims any responsibility for any harm resulting from the use of the Applications by users or from any downloading or interaction with content posted. Bulbul is not liable for any direct, indirect, incidental, or consequential damages resulting from any use of the Applications.

6. Intellectual Property

This Agreement does not transfer from Bulbul to you any Bulbul or third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with Bulbul . Bulbul , and all other trademarks, service marks, graphics and logos used in connection with the Applications are trademarks or registered trademarks of Bulbul or Bulbul ’s licensors. Other trademarks, service marks, graphics and logos used in connection with the Applications may be the trademarks of other third parties. Your use of the Applications grants you no right or license to reproduce or otherwise use any Bulbul or third-party trademarks.

7. Changes

Bulbul reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Applications following the posting of any changes to this Agreement constitutes acceptance of those changes. Bulbul may also, in the future, offer new services and/or features through the Applications (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

8. Termination

Bulbul may terminate your access to all or any part of the Applications at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your account (if you have one), you may simply delete your account from within the Applications. Bulbul will use reasonable efforts to remove your data from the database, but you acknowledge that caching or references to the Content may not be immediately unavailable and may persist for a reasonable period. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

The Applications are provided as is. Bulbul and its suppliers and licensors hereby disclaim all warranties of any kind, expressed or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Bulbul nor its suppliers and licensors, makes any warranty that the Applications will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through the Applications at your own discretion and risk.

10. Limitation of Liability

In no event will Bulbul , or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Bulbul under this agreement during the twelve (12) month period prior to the cause of action. Bulbul shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

11. General Representation and Warranty

You represent and warrant that (i) your use of the Applications will be in strict accordance with Bulbul Privacy Policy, with this Agreement and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside) and (ii) your use of the Applications will not infringe or misappropriate the intellectual property rights of any third party and (iii) You will adhere to the permitted and prohibited products and terms of advertisements applicable in your jurisdiction

12. Indemnification

You agree to indemnify and hold harmless Bulbul, its contractors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses, including attorneys' fees, arising out of or related to your use of the Applications, including but not limited to your violation of this Agreement, your violation of any rights of a third party (including intellectual property rights), your non-compliance with any applicable laws and regulations, and your violation of laws related to the country in which you are located, including laws governing the publishing of advertisements and prohibited advertisements.

13. Interactions with Third Parties

You acknowledge and agree that BulBul is not responsible for interactions between you and any third parties, including organizations or individuals, that occur through our platform. This includes, but is not limited to, transactions related to the purchase, sale, or rental of goods or services, and any other agreements or arrangements made through the platform.

Responsibility for Transactions: Any dealings, including payment, delivery of goods, or services, are solely between you and the third parties. Bulbul does not guarantee the accuracy, legality, or quality of the products or services offered by these third parties.
Limitation of Liability: Bulbul shall not be liable for any loss or damage incurred as a result of these interactions. This includes any issues related to the terms, conditions, warranties, or representations made by third parties.
Dispute Resolution: In the event of a dispute between users or between a user and a third party, Bulbul is under no obligation to become involved. You agree that Bulbul is not responsible for resolving such disputes and release us from any claims, demands, or damages (actual or consequential) related to these disputes.
Release of Liability: You agree to release Bulbul, its officers, employees, agents, and affiliates from any claims, demands, and damages, whether known or unknown, arising out of or in any way related to disputes with other users or third parties encountered through our platform.

14. Jobs

When posting job-related advertisements on Bulbul, users must ensure that their ads conform to the following criteria:

Correct Information: Ads must contain accurate information as specified in the criteria listed.
Original Photos: Photos from another user's advertisement in the system must not be used.
Single Advertisement: Only one advertisement per job is allowed on Bulbul.
No Duplicate Ads: Identical ads cannot be re-entered into the system by deleting the original and posting again. Accounts that delete and repost the same ad or engage in similar activities may have their ads removed, accounts temporarily suspended, or terminated.
No Overseas Employment Ads: Ads seeking jobs or employees for employment abroad are not allowed.
Relevant Descriptions: Ads must not contain descriptions unrelated to the job description or requirements, and must not include personal physical characteristics.
No Underage Recruitment: Ads seeking personnel under the age of 18 are not allowed.
Compliance with Local Laws: All job advertisements must comply with the employment laws and regulations of the user’s country.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.
Non-Discrimination: Job advertisements must not discriminate against candidates based on race, gender, age, disability, religion, nationality, or any other characteristic protected by law.

15. Real Estate

When posting advertisements related to renting or selling real estate on Bulbul, users must ensure that their ads conform to the following criteria based on their roles:

All Advertisers

Current Availability: You may only advertise properties that are currently available for sale or lease. It is at our discretion to remove any listings (advertising fees will not be refunded).
Lawful Content: You warrant that the advertisement does not contain unlawful language or use of the premises, including:
- Defamatory, misleading, or deceptive statements.
- Sharing of a property that exceeds lawful occupancy limits (including, but not limited to, bachelor accommodations and multi-family use).
- Sharing of a property between unrelated members of the opposite sex.
- Sharing of a property in any way that is deemed unlawful.
- Any other language that promotes illegal or immoral activities under the law of your local government.
Compliance with Local Laws: You are responsible for ensuring that your advertisement complies with all applicable local, regional, and national laws and regulations in your country, state, city, or other governmental area.
Accurate Information: Ads must contain accurate information as specified in the criteria listed.
No Duplicate Ads: Identical ads cannot be re-entered into the system by deleting the original and posting again. Accounts that delete and repost the same ad or engage in similar activities may have their ads removed, accounts temporarily suspended, or terminated.
Non-Discrimination: Ads must not discriminate against potential buyers or renters based on race, gender, age, disability, religion, nationality, or any other characteristic protected by law.
Prohibited Content: Ads must not contain misleading information, false claims, or content that is prohibited by law, including illegal properties or unverified listings.
Energy Efficiency Information: Where applicable, ads should include information about the energy efficiency of the property, as required by local regulations.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.
Owner Authorization: If you are not the owner of the property, you must have valid authorization from the owner to post the advertisement.
User Responsibility: It is your responsibility to confirm and comply with all rules and regulations in your local area. Bulbul is not responsible for ensuring compliance with local laws and regulations.

Brokers

Licensing: You warrant that you possess a valid license from your local government in which you are advertising.
Project Registration: If a project is off-plan (under construction), you warrant that the project is registered with your local government.
Subleasing and Short-term Leasing: If you are engaging in subleasing activities or short-term/holiday home leasing, you warrant that you possess the appropriate licenses for such activities.
Approval for Ads: As per your local government’s regulations, you might have to obtain approval for every sale or leasing advertisement and display the Permit Number, Office Registration Number, and Broker Registration Number on all advertisements.

Owners and Landlords

Authorization: You warrant that you are the owner/landlord of the property or possess valid authorization to list the property on Bulbul.
Short-term Leasing: If you are engaging in short-term or holiday home leasing, you warrant that you possess a license for the activity from your local government.
Accurate Information: Ads must contain accurate information as specified in the criteria listed.
Unique Photos for Each Ad: Different photos must be used for each ad. Even if the properties are in the same location, the same photos must not be used in more than one ad.

Tenants

Landlord Consent: You warrant that you possess valid, written consent from your landlord before advertising on Bulbul and that you are legally entitled to publish such an advertisement.
Accurate Information: Tenants posting sublet ads or seeking to transfer leases must provide accurate and truthful information about the property and the lease terms.

16. Vehicle

When posting advertisements related to selling or renting vehicles on Bulbul, users must ensure that their ads conform to the following criteria based on their roles:

General Requirements for All Advertisers

Owner Authorization: Vehicle advertisements must be posted by the owner of the vehicle or with the owner’s consent. This responsibility lies with the advertiser. If the owner objects, the account holder’s ads may be removed, and the account may be temporarily suspended or terminated.
Accurate Information: Ads must contain accurate information as specified in the criteria listed.
No Duplicate Ads: Identical ads cannot be re-entered into the system by deleting the original and posting again. Accounts that delete and repost the same ad or engage in similar activities may have their ads removed, accounts temporarily suspended, or terminated.
Unique Photos for Each Ad: Different photos must be used for each ad. Even if the vehicles are in the same location, the same photos must not be used in more than one ad.
Separate Ads for Sale and Rent: Separate ads must be created for selling and renting a vehicle. Details for both sale and rental cannot be included in the same ad.
No Placeholder Prices: Placeholder or representative prices must not be used for vehicles listed for sale or rent.
Lawful Content: Advertisements must not contain unlawful language or use of the vehicle, including:
- Defamatory, misleading, or deceptive statements.
- Any other language that promotes illegal or immoral activities under the law of your local government.
Compliance with Local Laws: You are responsible for ensuring that your advertisement complies with all applicable local, regional, and national laws and regulations in your country, state, city, or other governmental area.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.

Additional Requirements for Car Rentals

Rental Licensing: If you are engaging in vehicle rental activities, you must possess the appropriate licenses and permits required by your local government.
Proof of Ownership: You must have valid proof of ownership or authorization to rent out the vehicle.
Insurance: Ensure that all vehicles listed for rent are properly insured in accordance with local regulations.
Rental Terms and Conditions: Clearly state the terms and conditions of the rental, including duration, mileage limits, fuel policy, and any other relevant information.
Vehicle Maintenance: Ensure that all vehicles listed for rent are regularly maintained and meet the safety standards required by local regulations.
Driver Requirements: Specify any requirements for drivers, such as minimum age, valid driver’s license, and any other criteria relevant to the rental.
Comply with Rental Laws: Ensure compliance with all rental laws and regulations in the country of residence.

Vehicle Owners and Sellers

Proof of Ownership: You must have valid proof of ownership or authorization to sell the vehicle.
Vehicle Condition: Provide accurate details about the vehicle’s condition, including any damages or required repairs.
Vehicle History: Include a history report if available, detailing past accidents, maintenance records, and other relevant information.

General Responsibilities for All Users

User Responsibility: It is your responsibility to confirm and comply with all rules and regulations in your local area. Bulbul is not responsible for ensuring compliance with local laws and regulations.
Legal Compliance: Ensure that your advertisement does not violate any local, state, or national laws, including but not limited to those related to vehicle sales, rentals, and advertising.

17. Used and New Items

When posting advertisements for used or new items on Bulbul, users must ensure that their ads conform to the following criteria:

General Requirements for All Advertisers:

Owner Authorization: Item advertisements must be posted by the owner of the item or with the owner’s consent. This responsibility lies with the advertiser. If the owner objects, the account holder’s ads may be removed, and the account may be temporarily suspended or terminated.
Accurate Information: Ads must contain accurate information as specified in the criteria listed.
Unique Photos: Photos used in the advertisements must not belong to a different user.
No Duplicate Ads: Identical ads cannot be re-entered into the system by deleting the original and posting again. Accounts that delete and repost the same ad or engage in similar activities may have their ads removed, accounts temporarily suspended, or terminated.
Different Photos for Each Ad: Different photos must be used for each ad. Even if the items are in the same location, the same photos must not be used in more than one ad.
Comply with Sales Laws: Ensure compliance with any sales laws in the country of residence.
Prohibited Items: Do not sell a product that is prohibited from sale based on the laws of the country of residence or Bulbul's prohibited items as outlined in the community guidelines
Direct Sales Only: Ads should only be for products that you currently own and are available for immediate sale. Pre-order listings are not allowed.
No Placeholder Prices: Placeholder or representative prices must not be used for items listed for sale or rent.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.

Additional Requirements for Used Items:

Condition Description: Provide a clear and accurate description of the item's condition, including any defects or damages.
Usage History: If available, include a brief history of the item's use, such as previous ownership, usage frequency, and maintenance records.

Additional Requirements for New Items:

Original Packaging: If applicable, new items should be listed with details about their original packaging and any included warranties.
Authenticity Verification: Ensure that new items are genuine and not counterfeit. Advertisers should provide proof of authenticity if required.

General Responsibilities for All Users:

User Responsibility: It is your responsibility to confirm and comply with all rules and regulations in your local area. Bulbul is not responsible for ensuring compliance with local laws and regulations.
Legal Compliance: Ensure that your advertisement does not violate any local, state, or national laws, including but not limited to those related to item sales, rentals, and advertising.

18. Services

When posting advertisements for services on Bulbul, users must ensure that their ads conform to the following criteria:

General Requirements for All Service Providers:

Authorization: Service advertisements must be posted by the service provider or with appropriate authorization from relevant authorities. This responsibility lies with the advertiser.
Accurate Information: Ads must contain accurate information as specified in the criteria listed.
No Misrepresentation: Photos and details used in the advertisements must accurately represent the services offered.
No Duplicate Ads: Identical ads cannot be re-entered into the system by deleting the original and posting again. Accounts that engage in such activities may have their ads removed or accounts suspended.
Compliance with Legal Requirements: Ensure compliance with all applicable laws and regulations in the country of residence. This includes having the right to offer the advertised services and possessing any necessary licenses, permissions, and diplomas required to provide the services.
Prohibited Services: Do not advertise services that are prohibited under local laws or violate Bulbul's policies. Prohibited services may include, but are not limited to:
- Illegal activities or services promoting illegal activities
- Services requiring special licenses or permissions without appropriate documentation
- Services related to controlled substances or illegal drugs
- Any service deemed harmful or unsafe

General Responsibilities for All Service Advertisers:

Legal Compliance: It is your responsibility to ensure that your advertisement and services offered comply with all local, state, and national laws.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.
User Responsibility: You are responsible for confirming and complying with all rules and regulations applicable to your service offerings.

20. General Rules

General Advertising Rules

Accuracy of Information: All ads must contain accurate, truthful, and non-misleading information. Advertisers are responsible for ensuring that the details of the ad are correct and up to date.
No Duplicate Ads: Identical ads are not allowed. An ad that has been deleted cannot be reposted as a new ad. Duplicate ads will be removed, and the accounts may be subject to suspension.
Prohibited Content: Ads must not contain offensive, defamatory, or illegal content, including but not limited to hate speech, threats, and any content that violates local laws and regulations, the laws of the advertiser's country of residence, or Bulbul's rules and policies as outlined in this document.
No Misrepresentation: The photos and descriptions in the ads must accurately represent the item or service being offered. Use of stock photos or images that do not match the actual item/service is prohibited.
Respect for Privacy: Ads must not include personal information such as phone numbers, email addresses, or home addresses in the description or photos. Contact details should only be provided in designated fields.
Adherence to Guidelines: Ensure that the ad does not violate any of the points mentioned in the community guidelines.

Image and Content Guidelines

Authenticity: All images and videos used in the ads must be original and owned by the advertiser. Use of copyrighted images or images from other users is strictly prohibited.
Quality of Images: Images must be clear and of good quality. They should not contain watermarks, logos, or promotional text.
No External Links: Ads must not include links to external websites, other than those permitted by Bulbul.
No Promotional Content: Ads must not include promotional content unrelated to the item or service being advertised.

Compliance with Legal Requirements

Legal Compliance: Advertisers must ensure that their ads comply with all applicable local, state, and national laws and regulations, including the laws of their country of residence.
Licenses and Permits: For services that require special licenses or permits, advertisers must provide proof of these licenses or permits when requested.

Account Responsibilities

Single Account Use: Each user is allowed to maintain only one account. Creating multiple accounts for circumventing platform rules or to gain an unfair advantage is prohibited.
User Responsibility: Users are responsible for all activities conducted through their account and must ensure their account details remain confidential and secure.

Interactions with Third Parties

You acknowledge and agree that BulBul is not responsible for interactions between you and any third parties, including transactions related to the purchase, sale, or rental of goods or services. BulBul does not control or endorse any third-party websites linked to from the App and makes no representations regarding the accuracy or authenticity of content on such third-party websites. Linking to third-party websites is at your own risk, and BulBul disclaims all liability related to such third-party websites.

21. Miscellaneous

This Agreement constitutes the entire agreement between Bulbul and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Bulbul , or by the posting by Bulbul of a revised version. Except to the extent applicable by law, if any, provides otherwise, this Agreement, access to or use of the Applications will be governed by the laws of the Republic of Turkey, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the courts located in Istanbul, the Republic of Turkey. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled in accordance with the arbitration rules. The arbitration shall take place in Istanbul, the Republic of Turkey, in the Turkish language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys' fees. If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect. A waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. You may assign your rights under this Agreement to any party that consents to, and agrees to be bound by, its terms and conditions; Bulbul may assign its rights under this Agreement without condition. This Agreement will be binding upon and will inure to the benefit of the parties, their successors and permitted assigns.
